Welcome to Know My Patient ("we", "our", "us"). These Terms and Conditions govern your use of our website and services available at:

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you must not use our services.

You must:
- Be at least 18 years old
- Have authority to use or input data (especially patient data)
- Use the platform in a professional, lawful manner

If acting on behalf of an organisation, you confirm you have authority to bind that organisation.
Know My Patient is a digital information-sharing platform only.

We:
- Do not provide medical advice
- Do not replace clinical judgement
- Do not guarantee accuracy of user-submitted data

All clinical decisions remain the responsibility of qualified healthcare professionals.
You agree to:
- Provide accurate and up-to-date information
- Maintain confidentiality of login credentials
- Ensure lawful processing of any patient data uploaded
- Comply with UK GDPR, Data Protection Act 2018, and relevant healthcare regulations

You must not:
- Upload false, misleading, or harmful data
- Access data you are not authorised to view
- Attempt to breach or test system security
- Use the platform for unlawful purposes
Where you upload or manage patient data:
- You act as the Data Controller
- You are responsible for obtaining consent or lawful basis
- You must follow safeguarding and confidentiality obligations

We act as a Data Processor (see Privacy Policy for full details).
You are responsible for:
- Keeping your login details secure
- All activity under your account

We reserve the right to suspend or terminate accounts where:
- Security is compromised
- Misuse is detected
- Terms are breached
We aim to provide a reliable service but:
- Do not guarantee uninterrupted access
- May suspend or modify services for maintenance, upgrades, or security

We are not liable for downtime or service interruptions.
All content, branding, and system design on the platform are owned by Know My Patient, unless otherwise stated.

You may not:
- Copy, reproduce, or distribute platform materials
- Reverse engineer or attempt to extract source code
To the fullest extent permitted by law:

We are not liable for:
- Clinical decisions made using the platform
- Data inaccuracies entered by users
- Loss of data, income, or business
- Indirect or consequential damages

Our total liability shall be limited to the amount paid (if any) for use of the service.
You agree to indemnify and hold harmless Know My Patient against any claims, damages, or losses arising from:
- Misuse of the platform
- Breach of these Terms
- Unlawful handling of patient data
Your use of the platform is also governed by our Privacy Policy, which outlines:
- How data is processed
- Your rights under UK GDPR
- Security measures in place
We may suspend or terminate access:
- Immediately for serious breaches
- With notice for general violations

You may stop using the service at any time.

Upon termination:
- Access to data may be restricted
- Data handling will follow our retention and deletion policies
We may integrate third-party services (e.g., email, analytics). We are not responsible for:
- Their availability
- Their privacy practices
We may update these Terms periodically. Continued use of the platform constitutes acceptance of updated Terms.
These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

To protect patients, users, and system integrity, you agree not to:

18.1 Prohibited Activities
- Access or attempt to access data without proper authorisation
- Share login credentials or bypass authentication controls
- Upload malicious code, scripts, or harmful content
- Interfere with system performance, servers, or networks
- Use the platform for unlawful, fraudulent, or abusive purposes

18.2 Clinical Misuse

You must not:
- Upload fabricated, misleading, or clinically unsafe information
- Use the platform as a sole source for clinical decision-making
- Store excessive or irrelevant patient data beyond necessity

18.3 Enforcement

We reserve the right to:
- Suspend or terminate accounts immediately
- Restrict access to specific features
- Report unlawful activity to relevant authorities
For organisations subscribed to Know My Patient, we aim to deliver a high-availability service.

19.1 Availability Target
- Target uptime: 99.5% per calendar month (excluding scheduled maintenance)

19.2 Scheduled Maintenance
- Planned downtime will be communicated in advance where possible
- Typically conducted during low-usage periods
Know My Patient is not a clinical decision support system.

20.1 Intended Use

The platform is designed to:
- Support communication of patient preferences
- Provide supplementary contextual information
- Enhance, not replace, clinical workflows

20.2 Clinical Responsibility
- All clinical decisions must be made by qualified professionals
- Users must verify all information independently
- The platform must not be relied upon in isolation

20.3 Risk Acknowledgement

By using the platform, you acknowledge:
- Data may be incomplete, outdated, or inaccurate
- Delays or technical issues may occur
- Clinical risk remains with the healthcare provider

20.4 Compliance Position

The platform is developed with consideration of:
- DCB0129 (Clinical Risk Management - Manufacturers)
- DCB0160 (Clinical Risk Management - Deployment)

However, formal compliance certification is the responsibility of deploying organisations where applicable.
Know My Patient offers tiered subscription plans for passport holders and organisations.

21.1 Subscription Tiers

Basic Passport
- Core patient profile
- Essential information storage
- Limited feature access

Enhanced Passport
- Expanded patient records
- Additional customisation options
- Priority feature access

Ultimate Passport
- Full feature access
- Advanced modules (e.g., specialist passports, integrations)
- Priority support and future feature releases

21.2 Billing and Payments
- Subscriptions may be billed monthly or annually
- Fees must be paid in advance
- Failure to pay may result in suspension of access

21.3 Free Trials (If applicable)
- Trial access may be offered
- Automatically converts to paid unless cancelled

21.4 Upgrades and Downgrades
- Users may upgrade at any time
- Downgrades take effect at the end of the billing cycle

21.5 Cancellation
- Users may cancel subscriptions at any time
- Access continues until the end of the paid period
- No refunds unless required by law

21.6 Organisation Accounts

For organisations:
- They are responsible for all users under their account
- Must ensure staff compliance with these Terms
- May manage user roles and permissions centrally
We operate a continuous improvement model. As such:
- Features may be added, modified, or removed
- Subscription tiers may evolve
- Users will be notified of material changes
